The deaths of two television crew members in Ukraine in 2022 are at the center of a legal dispute over the decisions made when journalists cover war.

Ukrainian producer and interpreter Oleksandra “Sasha” Kuvshynova, 24, and veteran camera operator Pierre Zakrzewski were killed in a Russian strike near Irpin outside Kyiv on March 14, 2022. Two Ukrainian soldiers accompanying the crew also died. Correspondent Benjamin Hall survived with devastating injuries.

Warnings before the fatal assignment

A lawsuit filed by Kuvshynova’s parents and security adviser Shane Thomson describes repeated warnings. Thomson had advised the crew to stay away from Irpin, where fierce fighting was taking place. Journalist Brent Renaud had been killed in the area the previous day, and local authorities had restricted foreign journalists’ access.

The plaintiffs allege that the crew nevertheless headed toward the danger zone on March 14. After soldiers refused permission to film at one location, two Ukrainian escorts proposed an alternative route. Security adviser Duncan Gordon was left behind because there was no space in the vehicle. The car was subsequently struck by artillery fire.

What Sasha’s family alleges

Kuvshynova’s parents, Andriy Kuvshynov and Iryna Mamaysur, contend that Fox News failed to provide adequate information about their daughter’s death. They also challenge the circumstances in which her father signed a release of claims shortly after her death in connection with a payment from the network.

The case extends beyond the conduct of an individual correspondent. It raises questions about newsroom management, the authority of security advisers to halt assignments, and the position of local staff who often face disproportionate risks.

Fox News rejects allegations of negligence and says journalist safety is a top priority. It has criticized efforts to assign blame to Benjamin Hall, who was himself a victim of the attack.

In a December 29, 2025 ruling, a New York court granted some dismissal motions and denied others. It held that the release signed by Kuvshynova’s father was not sufficient at that stage to bar the proceedings. The ruling was not a final determination of responsibility for the deaths. Zakrzewski’s widow has also filed a separate lawsuit in London.

War reporting requires decisions under uncertainty, but the pursuit of exclusive footage does not eliminate the need for route planning, threat assessment and clear authority to stop an assignment.
